Powers Of Attorney
If for whatever reason you become unable to manage your own financial affairs, then it is likely that a relative or a professional person will have to apply to the Court of Protection to appoint themselves as a Deputy. They have no automatic legal right to deal with your affairs. The procedure is therefore lengthy and costly. However, this can be avoided!
A Lasting Power of Attorney allows you to plan ahead and provide for the time when you may lack capacity to manage your own affairs. Once completed, you must register the forms with the Office of the Public Guardian to be able to use them. It is important to note that the LPA can only be used after registration. This will make it easier and quicker for your Attorney(s) to start acting if and when you lose the capacity to make decisions.
There are two different types of LPA:
- The Property and Financial Affairs LPA – appoints someone to manage your property and financial affairs. The attorney will be able to pay your bills, receive income and benefits on your behalf or even sell your home. You can limit the extent of his or her powers by imposing restrictions and conditions.
- The Health and Welfare LPA – appoints someone to decide with regards to your personal welfare. The attorney can give or refuse consent to medical treatment. He or she can decide where you live. A Health and Welfare Attorney can look after your personal welfare from the moment you become unable to do so yourself. However, he or she cannot make decisions on your behalf about your property and affairs.
